These Practice Directions shall apply and be observed in the Supreme Court of Nigeria, in the determination of a pre-election, or an election appeal from the Court of Appeal. 2. An appellant shall file in the Registry of the Court of Appeal, notice and grounds of appeal within 14 days from the date of the delivery of the ruling, or judgment appealed against. 3. The Inter-American human rights system is one of the major regional human rights systems globally. In spite of the availability of human rights instruments in the region, some of which are legally binding, the spate of human rights abuse still leaves a sad commentary. The objective of this paper therefore is to take a critical survey of the human rights instruments in the region with a view to assessing their strengths and constraints. The method of research is basically doctrinal and utilizes the major human rights instruments in the region such as the Charter of the Organization of American States (OAS), the American Declaration of the Rights and Duties of man, and the American Convention on Human Rights in its evaluation. It is the finding of the paper that the Inter-American system indeed has a number of positive features such as the emphasis placed on democratic governance and third party interventions in the adjudicatory process among others. The paper has also identified a number of weaknesses in the system including that the Inter-American Commission lacks the power to refer a case to the Inter-American Court where the State concerned has not ratified the American Convention on Human Rights; and further, the Commission & rsquo;s recommendations are not legally binding. Therefore, the paper recommended among other things that the Commission be able to transmit a case directly to the Court whether or not the party concerned has ratified the American Convention.

If it is timeously carried out and effectively executed, garnishee proceedings is one of the surest ways through which judgment creditors can successfully obtain his money from a recalcitrant or stubborn debtor".

The article traces the evolution of FREP rules in Nigeria and highlights the problems which gave rise to FREP Rules, 2009. The article discusses the new rules and acknowledges that their objectives are laudable. For instance, the new Rules had to a large extent solved the thorny issues of how to commence human rights actions, expensive filing costs, service and limitation of action. However, the article notes that it is unusual for Rules of Court to have a preamble. The FREP Rules, 2009, therefore, depart from the usual standard. The fact that the laudable objectives of the FREP Rules are contained in a preamble may minimise their legal effect since preambles do not have the same legal force as substantive provisions. What is more, a number of provisions of the Rules are inconsistent with the provisions of the Constitution of Nigeria, 1999, and stand the risk of being declared null and void to the extent of their inconsistency in adversarial proceedings. On 1st November 2021, the new Court of Appeal Rules 2021 ( & ldquo;the 2021 Rules & rdquo; or & ldquo;the Rules & rdquo;) came into force, repealing the Court of Appeal Rules 2016 ( & ldquo;the 2016 Rules & rdquo;) and bringing several notable changes to the procedural operations of Nigeria & rsquo;s penultimate appellate court. With the COVID-19 pandemic still affecting the regular operation of many sectors, including the justice sector which faced notable delays, virtual proceedings are becoming common. In the 2021 Rules, notable changes have been made to reflect the new reality of virtual proceedings and innovative provisions prompting the expeditious disposal of appeals have been introduced as well. In the subsequent paragraphs, some of the notable changes introduced by the 2021 Rules are highlighted, alongside certain operational problems of the Rules which have already started cropping up. Innovations Introduced by the 2021 Rules Virtual Hearings: By virtue of Order 21 of the 2021 Rules, proceedings can now be conducted virtually. Court sittings are also defined to include both physical and virtual sittings of the court. The issues highlighted in the previous segment are teething troubles, as may be expected in the early days of any new statute and it is hoped that with time, these troubles are worn away. It is also our hope that as the new Rules are put into use, the President of the Court of Appeal shall issue Practice Directions, where necessary, to resolve some of the issues that may arise. In the interim, the innovative provisions of the 2021 Rules must be commended, as they indicate that the Nigerian Appellate Court is keeping with the times in which we find ourselves.
